Environmental liability insurance has been designed over the last 30 years to fill the coverage gaps and exclusions found in ISO CGL policies and respond to claims for losses or damages arising from unexpected releases of pollutants and contaminants into the environment. Commercial ISO CGL policies typically exclude coverage for risks that have pollution exposures.

Environmental Products

Coverage can be provided for environmental contractors, consultants, engineers, and laboratories on a package basis. The package policy combines Commercial General Liability (CGL) coverage with Contractor’s Pollution Liability, Non-Owned Disposal Site Liability (NODS), Professional Liability, and/or Transportation Pollution Liability. The CGL policy is written on an ISO occurrence form.

ISO Commercial CGL policies exclude Pollution Liability coverage, leaving the policyholder in need of insurance coverage for pollution exposures arising from third-party claims for pollution or contaminants released into the environment. Our Contractors Pollution Liability product is ideal for such situations, as it covers bodily injury, property damage, legal expenses, and clean-up costs resulting from pollution conditions arising from a company’s contracting operations.

Contractors Pollution Liability (CPL) covers bodily injury, property damage, legal expenses, and clean-up costs resulting from pollution conditions arising from a company’s contracting operations. Occasionally, a contract may require the contractor to show evidence of also having Professional Liability (PL) coverage. Professional Liability insurance coverage protects the policyholder from wrongful acts committed by the insured during their performance of professional services. Our combined CPL & PL product was designed to meet this requirement when the contractor’s Professional Liability (PL) exposure is truly incidental.

Our Site Pollution Liability policy offers insurance coverage for pollution releases associated with on/off-site cleanup costs and third-party on/off-site bodily injury, and property damage emanating at, on, or from a specific owned or leased location or premises. This enhanced policy features Premises Pollution coverage available for new pollution conditions and can also address the pollution exposures associated with above or underground storage tanks. Transporters of hazardous material and/or haulers of a regulated commodity are required to show evidence of clean up coverage in the event of a release. The MCS 90 coverage grant provides the transporter with a mechanism to meet this requirement. However, MCS 90 is not a risk transfer device, it only provides financial assurance. Our Transportation Pollution Liability (TPL) insurance coverage provides true occurrence form Pollution Liability for vehicles on a first and/or third party basis.

Our Environmental Excess Follow Form Liability offers Follow Form coverage on either a supported or unsupported basis. This insurance coverage attaches to scheduled underlying primary policies, including Commercial General Liability, Contractors Pollution Liability, Professional Liability, Site Liability, Business Auto Liability and Employers Liability. On an unsupported basis, we also offer Follow Form coverage over other environmental carrier’s scheduled underlying Commercial General Liability, Contractors Pollution Liability, Professional Liability, Site Liability, Business Auto Liability and Employers Liability policies.
